NY Affiliates and my merchants

I am very disheartened to see all the companies who are kicking out their New York affiliates: http://forum.abestweb.com/showthread.php?t=105393

Not one of my 20 brands have asked about the NY tax change. One that is based in NY wasn't even aware of it. I am not going to push this on them.

Working primarily through networks: Commission Junction, LinkShare, Performics, AvantLink I will look to the networks to advise on this. We have no insight into who is located in NY or selling there.

Therefore, we will not react to this "state" law at this time!

Thanks Chuck. No need to tell your New York firm. If they aren't collecting sales tax now, they have larger issues than their affiliate program :)

I did ask them and since they sell subscriptions they have not been collecting sales tax. I sent them the information and they are Manhattan based so would have expected them to know. Will see what they do.

Chuck, I would think it is your responsibility to address this with them, since they rely on YOU for information that relates to the affiliate side of their business. CJ sent a notice to merchants to check with their own lawyers, do YOU get that email or do you clients get it?

Someone has to tell them, they can't just ignore it.

I have passed it on to the account manager for the client who is in CJ, have not received comments back.

As an agency we are not going to mandate to our merchants that they take action, that is their decision.

I don't think you need to mandate them them to take action, but I would think you need to educate them on the implications so they can be aware of the situation and the possible consequences.

I agree this issue should be discussed and followed up writing to cover yourself.
