In an effort to clearly identify who NY based affiliates can feel safe in working with during this rocky time, I'd like to open this thread to be posted in by merchants who ALREADY collect New York sales tax on purchases, OR those whose physical goods do not, for whatever reason, fall into a taxable category.

Who this DOESN'T include:

E-books
Services
Subscriptions
Pharmaceuticals

What we want is a list of merchants that sell retail goods, and already have a nexus based on old legislation, in New York.

If you don't have a nexus here, but wish to continue working with NY affiliates, please start your own thread, and it will be appreciated. The reason for the distinction is simple: Your opinion, or that of your legal team, can change. :) And we want a list of guarantees.

Thanks all for your participation.

I guess a bunch that could be quickly added are the brick and mortar retailers in malls and stuff:

Barnes & Noble
Gap
Old Navy
Payless ShoeSource
Toys R Us
etc.

Since they have Dell in Wal-Mart, I wonder if that makes Dell charge sales tax?

I purchased a Dell from them directly two months ago and was charged tax in NJ. Not sure if it is due to Wal-Mart selling them or maybe they have a distribution center here?

Kitchen Collection has physical presence in NY. We have a CJ program and are looking for quality affiliates whose target audience loves to cook, garden, or decorate their home. We especially love bloggers who blog about cooking. When you join, please send an email to the program manager to introduce yourself.

Dell collects tax in NY.

As we do of course being based in NY

FWIW, Dell collects sales tax pretty much everywhere, possibly because of the walmart issue?

Dell Catalog Sales LP currently collects applicable sales tax in Alabama, Alaska, Arizona, Arkansas, California, Florida, Georgia, Hawaii, Idaho, Illinois, Kansas, Kentucky, Maine, Maryland, Michigan, Minnesota, Mississippi, Missouri, Nevada, New Jersey, New York, North Carolina, North Dakota, Ohio, Oklahoma, Pennsylvania, Rhode Island, South Carolina, Tennessee, Texas, Utah, Virginia, Washington, West Virginia, Wisconsin, and Wyoming.

I can't imagine it was feasible to have a distribution center or even an office in Alaska?? Although more likely, a walmart.
