Yep I assumed so also, I have read all the legal bullpucky at the various sites and saw nothing about the images so that means "FREE" /infopop/emoticons/icon_smile.gif

Unless it is clearly stated that the material is available for free use, you should not assume that it is.

Copyright is deemed to belong to the creator of the art, literary work, etc, whether or not it is specifically mentioned in legal disclaimers, etc., and others are not supposed to use the work without permission. That's the theory ...

Seeing something all over the place is not sufficient grounds for assuming that it's actually in the public domain. Unless the original creator explicitly gave it to the public domain, or has been dead for long enough (unlikely with computer art!) they retain their copyright and the fact that lots of people "borrow" their creation does not extinguish their intellectual property rights. That's the theory ... but compliance is difficult and enforcement even more so.

Intellectual property rights are a mess on the Internet. <sigh>

You are absolutely correct!

But It is very easy to attach a (C) statement to the image (in the comments), and I have yet to see one!

ALSO, It is the responsibility of the owner / inventor or artist to clearly identify ownership via (C), (TM), or Patent, to save and defend their rights! I seriously doubt a smilie (C) claim and I have never seen a case brought on a no waiver clause. <IMG src=http://www.abestweb.com/ubb/icons/icon15.gif>


But of course that doesn't mean that anyone can take smilies or other intellectual property with or without the appropriate marking (ie. (C)) without permission from the source

Never really thought of it before. BUT, let's assume that a smiley is made for a message board unless otherwise posted. I've got three smilies that I or my users hve made on my board and I'd be thrilled if I found them somewhere else.

Got to agree with Elizabeth on the copyright issue. Unless it's specifically stated that you can use the images they are covered by copyright.

That's how I understand it works in the UK and I believe the same applies in the US but I'm no lawyer so I may be wrong.
