(I am not too sure if these articles have been brought up already)

These articles from two years ago gives hope to all those fighting against the Gator-like ad targetting:

If Estee Lauder can win a lawsuit against Excite for selling targetted advertising based on Estee Lauder trademarks, it should be just as easy for another giant to win a similar lawsuit against Gator for selling targetted advertising based on the company's url.

I am sure there are many companies that would be more inclined to file suit against companies that practice url-based ad targetting if they knew the result of the Estee Lauder case.

Just my $.02.
