hmmm.... how can KBToys.com NOT collect sales tax when K.B.Toys bricks 'n' mortar stores DO? Even if they are two different companies it still sounds like tax fraud to me!

Gaiam.com, Inc. will pay for commissions earned before May 30, 2008 on Net Orders received through an affiliate link.
As a resident of New York State, please remove any affiliate referral links, banners, etc., to Gaiam.com by May 30, 2008. A resident of New York State is (a) any individual who maintains a permanent place of residence in New York State and (b) any corporation incorporated under the laws of New York and (c) any corporation, association, partnership or other entity doing business or maintaining a place of business in New York State. (See New York Sales and use Tax Regulation Section 526.15.)
We regret being placed in this situation and we hope we will be able to resume our relationship in the future.

As many of you may be aware, the State of New York recently enacted legislation amending New York Tax Law in an attempt to force certain sellers to collect state tax on all sales to residents of the State of New York.
Unfortunately, due to the State of New York¿s new legislation, we¿re temporarily discontinuing our current relationships with our New York affiliates.
Accordingly, BabyUniverse will be terminating our affiliate agreement, effective immediately. However, any commissions due, prior to the termination will still be paid in full as part of your May Invoice.
We regret that BabyUniverse has been put in this position and look forward to renewing our relationship in the future, should the situation be resolved.

That Nothern Tool email doesn't say anything about NY, looks like a regular termination email. So not adding that one. It's only for terminations because you're a NY affiliate.

Footsmart is heading South
There is currently legislation pending in New York State that may impact online sales tax requirements associated with sales agents based in New York. As a precaution, FootSmart is temporarily deactivating New York-based publishers from the FootSmart Affiliate Program.
You will be notified if the situation in New York is resolved and FootSmart makes a final decision regarding relationships with New York based publishers.

Sorry folks, we worked and tried really hard to prevent this decision with both these merchants.
As OPM's, I can tell you this financially affects all of us, nobody wins in this situation ....

I was about to post this, too. A lot of Avantlink merchants are taking this same stance which, IM HO, is at least reasonable. Why can't all merchants do the same?!
Instead of running off with their tail between their legs and pissing on their NY affiliates, they could have thought it out or fought alongside Amazon. Dropping NY affs is the chicken sh!t way out. Buncha p*ssies! What's gonna happen IF this law passes and all other states jump on the wagon? Is no one else willing to fight this?
I haven't been here for almost 2 days because I'm swamped pulling links. Think I'll go get drunk and stay offline for the rest of the night before somebody's head rolls. LOL

One of my first posts on this forum was on that very topic, and I was accused of comparing the issue to genocide or something. We are very willing to fight and have and are still doing so. Kevin has a thread going that IMHO is dead on about the industry as a whole. We are the industry, if we don't save it NO one else will!

Accordingly, Fingerhut hereby terminates all affiliate agreements currently in place with affiliates who are legal or tax paying residents of the State of New York, as of May 30, 2008 (the “Affected Affiliates”). Any money due to Affected Affiliates as of May 30, 2008 will be paid in the ordinary course. In connection with termination of these agreements, all Affected Affiliates should immediately remove and/or cease use of all references to Fingerhut in or on any of your affiliate materials.
We regret that Fingerhut has been put in this position and wish you all the best in your future business endeavors.
