hmmm.... how can KBToys.com NOT collect sales tax when K.B.Toys bricks 'n' mortar stores DO? Even if they are two different companies it still sounds like tax fraud to me!

Default Gaiam.com

I just received this:
Quote:
May 29, 2008

VIA email and LINKSHARE INBOX

Dear Affiliate,

As you may be aware, the State of New York recently enacted legislation amending New York State Tax Law in an attempt to coerce online retailers to collect sales tax on orders shipped to New York residents and referred by affiliates residing in the State of New York.

Unfortunately, Gaiam.com, Inc. has no tax nexus in the state of New York. Due to this legislation, we believe it is prudent to exercise our right, pursuant to Section 5 of our Affiliate Terms and Conditions, to terminate our affiliate agreement with New York based affiliates as of May 30, 2008. Gaiam.com, Inc. will pay for commissions earned before May 30, 2008 on Net Orders received through an affiliate link.

As a resident of New York State, please remove any affiliate referral links, banners, etc., to Gaiam.com by May 30, 2008. A resident of New York State is (a) any individual who maintains a permanent place of residence in New York State and (b) any corporation incorporated under the laws of New York and (c) any corporation, association, partnership or other entity doing business or maintaining a place of business in New York State. (See New York Sales and use Tax Regulation Section 526.15.)

We regret being placed in this situation and we hope we will be able to resume our relationship in the future.

Thumbs down Baby Universe

As many of you may be aware, the State of New York recently enacted legislation amending New York Tax Law in an attempt to force certain sellers to collect state tax on all sales to residents of the State of New York.

Unfortunately, due to the State of New York¿s new legislation, we¿re temporarily discontinuing our current relationships with our New York affiliates.

Accordingly, BabyUniverse will be terminating our affiliate agreement, effective immediately. However, any commissions due, prior to the termination will still be paid in full as part of your May Invoice.

We regret that BabyUniverse has been put in this position and look forward to renewing our relationship in the future, should the situation be resolved.

Sincerely,

Stephanie Swanson

Affiliate Marketing Manager

big one for me... Backcountry.com
Quote:
In accordance with the New York State tax laws [TSB-M-08(3)S, Sales Tax, May 8, 2008] we regret that we are no longer able to transact business from “vendors” residing in the state of New York who solicit sales from New York State residents. The law defines “vendors” as stated: “employees, independent contractors, agents or other representatives and, by reason thereof, make sales to persons within the state of tangible personal property or services that are subject to sales tax.”

We have enjoyed working with you and other affiliates who are in New York and regret that we must, by the above tax law, expire the relationship between Backcountry.com and New York based affiliates. We are in the process of working through a solution—we hope this is just a short-term obstacle—that will again allow us to transact business with New York based affiliates.

We will keep you up-to-date on any progress and hope you understand our position. We look forward with hope to working with you in the near future.

Best regards,

and Northern Tool

We appreciate your interest in the Northern Tool affiliate program however; due to inactivity in your account your relationship withNorthern Tool is being deactivated.

Recently, Northern Tool evaluated all affiliate relationships to optimize the program. After much consideration, the Northern Tool team has decided to focus distribution on affiliates with a proven track record of driving sales for Northern Tool.

Effective immediately, all affiliates who have not generated any sales in the last year will be resigned from the program.

Please remove any Northern Tool banners and/or links from your site as soon as possible.

Again, we appreciate your support of this decision along with your interest in Northern Tool and apologize for any inconvenience. If you have any questions, please contact us at northerntoolaffiliates@performics.com.

That Nothern Tool email doesn't say anything about NY, looks like a regular termination email. So not adding that one. It's only for terminations because you're a NY affiliate.

Adding the Backcountry one. Thanks.

Footsmart is heading South

There is currently legislation pending in New York State that may impact online sales tax requirements associated with sales agents based in New York. As a precaution, FootSmart is temporarily deactivating New York-based publishers from the FootSmart Affiliate Program.

You will be notified if the situation in New York is resolved and FootSmart makes a final decision regarding relationships with New York based publishers.

Trust, add RSI and CU. The RSI email went out this week and the CU notice will go out tonight, still being tweaked by their legal team ...

Sorry folks, we worked and tried really hard to prevent this decision with both these merchants.

As OPM's, I can tell you this financially affects all of us, nobody wins in this situation ....

Corner Stork Baby Gifts - did not drop NY affiliates, but did change the affiliate agreement for NY affiliates, so I thought I would post it.

Quote:
The following policies only apply to New York state residents.

As you probably know the latest buzz in the affiliate marketing community has been the law regarding NY state affiliates. We are going to revise our terms and conditions in a way that will probably not affect the majority of our New York based affiliates, but we need you to take a look at them and make sure that you're ok with them. In general terms, if the only way that you are promoting Corner Stork Baby Gifts is via link(s) on your website, then you are ok.

The types of marketing activities that we have to prohibit include the following:
PPC marketing
E-mail marketing (newsletter or promotion e-mails)
Print advertising (flyers, business cards)
Lead generation
Mobile marketing
Telemarketing
The state of New York has not yet provided a clear list so we are requesting that you only market us through website links. We greatly value your partnership, and hope that these new terms and conditions do not affect any current practices you are engaged in on behalf of Corner Stork Baby Gifts. Please let me know if you have any questions and thank you for your understanding and cooperation.

The above policies only apply to New York state residents.

I was about to post this, too. A lot of Avantlink merchants are taking this same stance which, IMHO, is at least reasonable. Why can't all merchants do the same?!

Instead of running off with their tail between their legs and pissing on their NY affiliates, they could have thought it out or fought alongside Amazon. Dropping NY affs is the chicken sh!t way out. Buncha p*ssies! What's gonna happen IF this law passes and all other states jump on the wagon? Is no one else willing to fight this?

I haven't been here for almost 2 days because I'm swamped pulling links. Think I'll go get drunk and stay offline for the rest of the night before somebody's head rolls. LOL

"Is no one else willing to fight this?"

One of my first posts on this forum was on that very topic, and I was accused of comparing the issue to genocide or something. We are very willing to fight and have and are still doing so. Kevin has a thread going that IMHO is dead on about the industry as a whole. We are the industry, if we don't save it NO one else will!

RE: Important Changes to the Fingerhut Affiliate Program

Dear [NY Affiliate]:

As many of you may be aware, the State of New York recently enacted legislation amending the New York Tax Law in an attempt to require certain sellers to begin collecting sales tax on all sales to residents of the State of New York, effective June 1, 2008.

Fingerhut Direct Marketing, Inc. (“Fingerhut”) has no tax nexus in any state other than Minnesota, the home of our corporate headquarters. Unfortunately, due to the new State of New Work legislation, we now believe it prudent to discontinue our current relationships with our New York based affiliates.

Accordingly, Fingerhut hereby terminates all affiliate agreements currently in place with affiliates who are legal or tax paying residents of the State of New York, as of May 30, 2008 (the “Affected Affiliates”). Any money due to Affected Affiliates as of May 30, 2008 will be paid in the ordinary course. In connection with termination of these agreements, all Affected Affiliates should immediately remove and/or cease use of all references to Fingerhut in or on any of your affiliate materials.

We regret that Fingerhut has been put in this position and wish you all the best in your future business endeavors.

I am being inundated with these New York affiliate terminations
Quote:
Dear New York State Publishers:

We regret to inform you that as of tomorrow, May 30, 2008, we will be terminating all merchant/publisher relationships with affiliates based in New York State.

This action is a direct result of the recent legislation concerning the New York State Tax Law effective June 1, 2008. Please see the Technical Services Bulletin posted on Linkshare's site for further details. http://www.linkshare.com/advertisers/ny_state_tax/

We sincerely thank you for two years of hard work and mutual benefit. Please note that we welcome you to reapply if this law is ever overturned or if you are able to establish nexus in another state without such taxation.

Best wishes and much success to you in future endeavors.

Kindest Regards,
Thompson & Co. of Tampa, Inc

"As a result of the recent legislative issues surrounding NY State, after much careful consideration, we have come to the unfortunate conclusion that we are going to need to disaffiliate you from our program at this time. We very much appreciate your past contributions to the Acorn Media program and we will contact you should anything change in the future. Thanks very much for your past affiliation."
